D.No.2-17-101/1, Subbamapeta Road, Jangareddygudem, Eluru District Petitioner/Accused No.2 AND The State of Andhra Pradesh, through Prohibition & Excise Station, Jangareddygudem, Eluru District, rep. by its Public Prosecutor, High Court for the State of Andhra Pradesh Amaravathi. Respondent Petition under Section 482 of BNSS is filed praying that in the circumstances stated in the affidavit filed in support of the Criminal Petition, the High Court may be pleased to enlarge the petitioner/Accused No.2 on bail in the event of his arrest in connection with FIR No. 61/2025 dated 08.04.2025 on the file of Prohibition & Excise Station, Jangareddygudem, Eluru District. The petition/Appeal coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of Sri RAJA DAMOJI RAO Advocate for the Petitioner, PUBLIC PROSECUTOR (AP) for the Respondent and the Court made the following.

Order: The Criminal Petition, u/Sec.482 of B.N.S.S is filed on behalf of the petitioner/A2 to grant anticipatory bail in connection with Crime No.61/2025 of Prohibition & Excise Station, Jangareddygudem, Eluru District.
2. A case has been registered against the petitioner/A2 herein and others for the offences punishable under Sections 7(B) r/w 8(A)(B) of A.P.Prohibition (Amended) Act, 2020. The
brief facts of the case are that this is a case of manufacturing of ID liquor that took place on 08.04.2025 at Bineru Lanka Kaluva Embankment located Northen side to the Pangidigudem Village of Jangareddygudem where the police found one person standing beside of the drum and stirring with stick in a drum, on seeing the police he tried to escape from there and the police catch him and police found FJ wash that is used for manufacturing of ID LIQUOR. Then the police seized ID liquor and registered the crime.

Learned counsel for the petitioner submits that, based on the confession of co-accused, the crime was registered against

2 petitioner/A2. Except for the confession of co-accused, no other independent material has been collected to show the involvement of A2 in the commission of the offence. The learned counsel for the petitioner further submits that the petitioner has a permanent abode at Jangareddygudem, Eluru District, and there is no possibility of his fleeing away from the Jurisdiction of the Court. Learned Assistant Public Prosecutor, while opposing the prayer of the petitioner, submits that the investigation is not complete. When ascertained the learned Assistant Public Prosecutor confirmed that the petitioner has no criminal antecedents.

In view of the facts and circumstances of the case, since the petitioner herein is arrayed as accused No.2 basing on the confessional statement of co-accused and the most of the witnesses are shown to be official witnesses, this Court is inclined to grant anticipatory bail to petitioner/A2, on the following conditions:

directed to surrender before the Station House Officer concerned within two (2) weeks from today and on such surrender, the petitioner/A2 shall be released on bail on his executing a personal bond for a sum of Rs. 10,000/- (Rupees ten thousand only) with one surety for a like sum to the satisfaction of the arresting police officials. After release, the petitioner/A2 shall cooperate for investigation and shall appear before the investigating officer as and when his
3 presence is required. The petitioner/A2 shall not threat, inducement or promise to the prosecution witnesses. cause any
