By means of the bail application the applicant has prayed to be enlarged on bail in Case Crime No. 74 of 2023 at Police Station- Gyanpur, District- Bhadohi under Section 7 of Criminal Law Amendment Act and Section 3 (1) of U.P. Gangster and Anti Social Activities (Prevention) Act, 1986. The applicant is in jail since 16.06.2023. The bail application of the applicant was rejected by the learned trial court on 16.08.2023. The following arguments made by Shri Ashvni Mishra, learned counsel on behalf of the applicant, which could not be satisfactorily refuted by Shri Durgesh Kumar Pandey, learned counsel on behalf of the first informant and Shri Chandan Agarwal, learned AGA-I from the record, entitle the applicant for grant of bail: 1. The applicant has been enlarged on bail by order dated 17.04.2025 in the same offence under Sections 147, 149, 323, 325, 302, 307, 504, 506 IPC by this Court in Criminal Misc. Bail Application No. 12230 of 2025 (Aakash Shukla v. State of U.P.). 2. This is the bail application in the added sections i.e. Section 7 of Criminal Law Amendment Act and Section 3 (1) of U.P. Gangster and Anti Social Activities (Prevention) Act, 1986. 3. The applicant is entitled to be enlarged on bail in this case as well on the same grounds as in the bail order dated 17.04.2025 passed by this Court in Criminal Misc. Bail Application No. 12230 of 2025 (Aakash Shukla v. State of U.P.). Let the applicant- Aakash Shukla be released on bail in Case Crime No. 74 of 2023 at Police Station- Gyanpur, District- Bhadohi under Section 7 of Criminal Law Amendment Act and Section 3 (1) of U.P. Gangster and Anti Social Activities (Prevention) Act, 1986 under the same conditions. The bail application is allowed.
