Neutral Citation No. - 2025:AHC:25914-DB Court No. - 29 Case :- WRIT - C No. - 1843 of 2025 Petitioner :- Yashpal Singh Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Ashwani Tripathi,Ramanuj Tripathi Counsel for Respondent :- C.S.C.,Krishna Kant Singh Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Petitioner contends that a project of Solid and Liquid Waste Management is being established in the village on a particular plot, which is less than 200 meters from the village abadi. It is alleged that this is likely to create inconvenience and nuisance for the residents of the village. A mandamus, therefore, is prayed for to restrain the respondents from establishing the Solid and Liquid Waste Centre near the abadi area. Learned Standing Counsel opposes the petition on the ground that there is a dispute in respect of the land over which such project is installed between the petitioner and certain other and filing of the writ petition is with an oblique motive. Be that as it may, the question as to what would be the ideal location for establishment of Solid and Liquid Waste material in the village can always be got examined by the second respondent, at the first instance. In that view of the matter, we permit the petitioner to approach the second respondent raising his grievance, as is noticed above, alongwith a certified copy of this order, within a week from today. The District Magistrate, Aligarh would get the facts verified and would ensure that appropriate action, as may be warranted in law, is taken keeping in view the provisions of Solid Waste Management Act, 2016 or any other applicable law on the matter in issue. Such action would be taken, within a further period of six weeks, thereafter. Order Date :- 24.2.2025 Anil Digitally signed by :- ANIL KUMAR PATEL High Court of Judicature at Allahabad
