I I Considering the prayer made as also the order proposed to be passed, 2. notice to the respondent is dispensed with. 3. The respondent is the plaintiff who filed O.S.No.51 of 2025 for recovery of money based on the promissory note. The petitioner is the defendant. He filed an application being I.A.No.787 of 2025 under Section 45 of Indian Evidence Act to send the promissory note to the hand writing expert for comparison of the signatures thereon. The said application has been rejected by an order dated 19.08.2025 on the ground that the petitioner did not provide contemporaneous documents for comparison of signatures. 4. Learned counsel for the petitioner does not dispute but submits that for certain reasons, the contemporaneous documents could not be provided. 5. Consequently, there is no illegality in the order passed, which call for no interference. 6. However, learned counsel for the petitioner prays that the liberty may be granted to file fresh application along with the document in comparable nature. 7. The Civil Revision Petition is dismissed but granting the said liberty. No order as to costs. As a sequel thereto, miscellaneous petitions, if any pending, shall also stand closed.
