HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU Case:- WP(C) No. 2556/2024 CM No. 6214/2024 Building Operation Controlling Authority …..Appellant(s)/Petitioner(s) Through: Mr. Rajnish Raina, Advocate. Vs Shyam Lal Sharma and another .…. Respondent(s) Through: Mr. D. K. Khajuria, Advocate for R-1. Coram: HON’BLE MR. JUSTICE RAHUL BHARTI, JUDGE ORDER (16.05.2025) 1. Mr. D. K. Khajuria, learned counsel for the respondent No. 1 submits that in terms of building permission No. 963/JMC/65/2024-24 dated 09.01.2024, the petitioner’s cause in the writ petition against the order dated 26.02.2024 of the J&K Special Tribunal, Jammu is rendered infructuous. 2. The instant writ petition is, accordingly, dismissed as infructuous with a right to seek revival reserves in favour of the petitioner, in case, the petitioner would reckon that the writ cause was alive to be pursued by the writ petitioner to its logical end or in the event the petitioner has indulged in any fresh act of omission of commission in the construction of building then the disposal of the writ petition would not prejudice the petitioner to initiate the appropriate legal course of action.
