ORDER:
The instant petition under Section 482 of the Code of Criminal Procedure, 19731 has been filed, by the Petitioner/Accused, seeking to quash the Order dt. 14.07.2025 passed by the Family Court cum IX Additional District and Sessions Court, Rajamahendravaram, in CrI.R.P. No.54/2020, which upheld the order dated 31.01.2020 in MC No.81/2017 passed by the IV Additional Junior Civil Judge, Rajamahendravaram
02. Heard Sri Raviteja Jammalamadaka, learned counsel for the petitioner, and Ms. K. Lakshmi Prasanna, learned Assistant Public Prosecutor appearing on behalf of the State.
03. The petitioner herein is the father of the minor child i.e., respondent No.2) and respondent No.3. The maintenance case in M.C. No. 81 of 2017 was filed by the minor daughters through her mother seeking maintenance. The learned IV Additional Junior Civil Judge, Rajamahendravaram, upon due
consideration, allowed the petition and granted maintenance to the daughters. The said order was confirmed by the Family Court-cum-IX Additional District and Sessions Judge, Rajamahendravaram in Crl.R.P. No. 54 of 2020.
04. Learned counsel for the petitioner contended that the Courts below erred in directing payment of maintenance from the date of the petition, and that it ought to have been granted only from the date of the order. He further
submitted that the wife of the petitioner, who is the mother of the minor children, did not file her salary certificate, and that the petitioner’s financial capacity was not properly appreciated by the Courts below.

This Court, having considered the submissions made and perused the material available on record and finds that both the Courts below, this Court finds that they are reasoned and well-considered, and no ground is made out to interfere with the same in exercise of inherent powers under Section 482 Cr.P.C. The plea regarding the date of commencement of maintenance is a matter within the discretion of the trial Court and has been rightly decided in accordance with settled principles of law.
06. In view of the above, this Court finds no merit in the contentions raised by the petitioner. However, if the petitioner is aggrieved by the quantum or seeks modification, it is open to him to approach the competent Court by following the due procedure in accordance with law.
Accordingly, this Criminal Petition is disposed of. There shall be no
order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed.
