Sl.No. 125 Court No. 35 G.S.Das 17.03.2025 WPA 445 of 2022 Ruma Ojha -Vs- The State of West Bengal & Ors. Mr. Mukteswar Maity Ms. Manika Sarkar … for the Petitioner(s) Ms. Pratiti Das … for the State-respondent(s) The petitioner is aggrieved by the fact that in spite of the representation made to the Officer-in-charge of Narayanpur Police Station on or about 28.10.2021, no steps have been taken by the concerned police authorities. Since none appears on behalf of the State, Ms. Pratiti Das, learned advocate, is directed to represent the State. Her appointment may be regularized by the concerned authorities. The petitioner’s grievance is that the private respondents are attempting to dispossess her as also in respect of recovery of the consideration money which has been paid. So far as the issue relating to recovery of money is concerned, the petitioner would be at liberty to approach the jurisdictional Court concerned – be it civil and/or criminal. So far as the issue relating to petitioner’s apprehension that she may be dispossessed from the property, I am of the view that if the situation still persists, the police authorities would see to that without due process of law, the petitioner by no means is dispossessed from the property concerned. With the aforesaid observations, WPA 445 of 2022 is disposed of. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. (Tirthankar Ghosh, J.)
