Samarjit, learned PP assisted by Mr. W. Niranjit, learned Dy. G.A. for the State respondent Nos. 1, 2 & 4, Mr. S. Suresh, learned counsel for respondent No. 3 and Mr. K. Roshan, learned counsel for respondent No. 5. [2] By the present petition, the petitioner is praying for directing the official respondents to take appropriate legal steps against respondent No. 5. [3] It is stated that during the pendency of the petition, Sr. Superintendent of Police, Vigilance & Anti-Corruption, Manipur has informed the Chief Engineer, Water Resource Department, Government of Manipur vide letter dated 19.01.2024 for initiating a complaint case in respect of 21 Assistant Engineers to the post of Executive Engineers in the same department. [4] Mr. E. Premjit, learned counsel for the petitioners, submits that in view of the subsequent event as recorded in the letter dated 19.01.2024, the cause of the petition has become infructuous and the same may be closed. [5] Learned counsel for the respondents have no objection. [6] Mr. S. Suresh, learned counsel for respondent No. 3, raises the question of maintainability of the present criminal petition filed by the petitioner. [7] Mr. H. Samarjit, learned PP, also raises the question of maintainability. [8] However, Mr. K. Roshan, learned counsel for respondent No. 5, has no objection in allowing the prayer of the petitioners for closing the present petition as infructuous. [9] Recording the submissions made at the bar and in view of the subsequent even in terms of the letter dated 19.01.2024 of the Sr. Superintendent of Police, Vigilance & Anti-Corruption, Manipur, the cause of the petition does not survive and is closed as infructuous.
