JUSTICE D K SINGH) This Writ Appeal is filed impugning the order dated 19.02.2024 passed by the learned Single Judge in W.P.No.42748/2014, whereby the learned Single Judge has confirmed the award passed by the Labour Court dated 30.10.2013 passed in I.D.No.49/2010. 2. Learned Single Judge after considering the report of the Security Officer who investigated the genuineness of the transfer certificate issued in favour of the appellant which was the basis for him being appointed as a driver in the respondent -Corporation, was of the - 3 - HC-KAR NC: 2025:KHC:42529-DB WA No. 796 of 2024 view that the appellant had obtained the appointment by playing fraud and availed the appointment to the post by producing fake transfer certificate of Middle High School. The learned Single Judge has held that once the fake transfer certificate of the appellant came to the knowledge of the respondent -Corporation conducted enquiry and found that the transfer certificate obtained by the appellant submitted to get public employment was fake certificate, terminated the employment. 3. There is nothing on record to suggest that the certificate was not a fake certificate. If a person obtains a public employment by playing fraud, he cannot claim any benefit in equity on the basis of his long continuation in employment inasmuch as his appointment in the employment would be void ab-initio. The appellant was not qualified to the appointment, he obtained appointment by playing fraud, and therefore we do not find any scope to interfere with the order passed by the learned Single Judge. - 4 - HC-KAR NC: 2025:KHC:42529-DB WA No. 796 of 2024 4.
