The applicants have preferred this First Bail Application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Crime No.404/2025, registered at Police Station: Sheorinarayan, District – Janjgir-Champa (C.G.) for the offences punishable under Sections 20 (b)(ii)(c) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, for short, the NDPS Act. 2. The prosecution story, in brief, is that on 14.09.2025, the SHO of Police PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2025.12.15 18:54:14 +0530 2 Station Sheorinarayan, namely Pravin Kumar, received secret information that two persons were transporting contraband ganja in a grey Ford Figo car bearing registration No. CG-10-FA-1143, from Deoribhuiya to Lawan. Acting upon the information, the police recorded the Rojnamcha Sanha, summoned independent witnesses, constituted a search team, and proceeded to the spot, i.e., Deori turning. The police intercepted the vehicle, informed the occupants about the secret information, and conducted a search of the vehicle’s boot, wherein 22 packets containing ganja covered with plastic tape were allegedly seized. It is stated that after complying with the mandatory provisions relating to search and seizure, the police weighed the ganja, prepared the Dehati Nalishi, arrested the applicants, deposited the seized articles in the Malkhana, registered the FIR, and after completing the investigation, filed the charge-sheet. 3. It has been argued by the learned counsel for the applicants that the applicants are innocent and have been falsely implicated in this case. It is further submitted that the police has not complied with the mandatory provisions of search and seizure and not informed the right to search before the Gazetted Officer or before Magistrate which vitiates the entire seizure and investigation. Further the charge-sheet has been filed and the applicants have no previous criminal antecedents. The applicants are in jail since14.09.2025. The conclusion of the trial is likely to take some time, therefore, he prays for grant of bail. 4. On the other hand, the learned counsel for the State opposes the bail application and submits that the quantity of 22.850 kilograms contraband (ganja) has been seized from the joint possession of the applicants, which is much more than the commercial quantity. Further, the charge-sheet has been submitted. Hence, his bail application is liable to be dismissed. 3 5. I have heard learned counsel for the parties and perused the material available on record. 6. Taking into consideration the fact that quantity of contraband article i.e. 22.850 kilograms of Ganja, which is much more than the commercial quantity, and the applicants have failed to give any explanation for the same and it cannot be said to be a case of false implication, accordingly, the bail application of applicant Nos. 1 and 2 – Bablu Sahu and Arjun Chandrakar involved in Crime No.404/2025, registered at Police Station: Sheorinarayan, District – Janjgir-Champa (C.G.) for the offences punishable under Sections 20 (b)(ii)(c) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, for short, the NDPS Act, is rejected. 7. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 8.
