ORAL ORDER Heard learned counsel for the petitioner and learned Additional Government Advocate for respondent No.1. Notice to respondent Nos.2 and 3 is dispensed.
2. What is sought by the petitioner in this petition is a writ of mandamus for a direction to respondent No.1 to take up the appeal preferred by the petitioner questioning the order passed by respondent No.2. It is the grievance of the petitioner that despite the appeal having been filed on 8/12/2025, no proceedings are initiated by respondent No.1. Hence, he is before this Court contending that if the appeal is not heard and disposed and if the letter of intent is issued pursuant to respondent No.3 being successful, the very purpose of filing appeal would get frustrated. Hence, he seeks an order of direction to respondent No.1 to dispose of the appeal expeditiously within a period as contemplated under Section 16 of the Karnataka Transparency in Public Procurements Act, 1999 (for short 'KTPP Act').
3. I am in agreement with learned counsel for the petitioner that as per Section 16 of the KTPP Act, an appeal

once preferred challenging the order of respondent No.2 requires to be disposed of within a period of 30 days from the date of filing of the appeal. Admittedly, in the present case, two weeks have already gone by and no orders have been passed. Looking into the provisions of the KTPP Act, it appears that the present petition is premature as the time is not yet expired. Therefore, the appeal which is pending before the Appellate Authority i.e., respondent No.1 would have to be
disposed of within the period of 30 days as contemplated under Section 16 of the KTPP Act.
4. It is open to respondent No.2 to issue letter of intent pursuant to the expiry of 30 days. Accordingly, writ petition stands disposed off.
