ORAL ORDER This petition is filed by accused No.5 under Section 483 of BNSS praying to grant bail in Crime No.33/2025 of Hebbala Police Station registered for offences under Section 309(4) of BNS and Section 27 of Arms Act.
2. Heard learned counsel for petitioner and learned Additional SPP for respondent/State.
3. Learned counsel for petitioner would contend that the petitioner has not committed any offence as alleged. The recovery of silver articles is from accused Nos.4 to 6. Petitioners have been taken to police custody and investigation has been done. Therefore, the petitioners are

not required for further custodial interrogation. With this, he prayed to allow the petition.
4. Per contra, learned Additional SPP would contend that the petitioners along with other accused have taken part in robbery and robbed silver articles have been distributed among the accused. Out of them, 1 kg 750 gram silver articles have been recovered from a bag pertaining to petitioner/accused No. 5. The investigation is in progress. The offence alleged against the petitioner is a heinous offence. The exact role of the petitioner has to be ascertained. With this she prayed for dismissal of the petition.
5. Having heard learned counsels, the Court has perused the FIR, complaint and other materials placed on record.
6. The accusation against this petitioner and other accused is that on 29.07.2025, by showing revolver and knife, they robbed silver articles kept in the locker and in

that respect, the crime came to be registered in Hebbala Police Station in Crime No.33/2025 for the aforesaid offences. The petitioners have been arrested on 13.08.2025 and under remand application dated 14.08.2025, six day’s police remand has been sought. Thereafter, what happened in the police custody and further remand application has not been placed on record. Therefore, what is the exact role of the petitioner has to be ascertained after filing of final report. The investigation is in progress. The offence alleged against the petitioner is heinous offence. Therefore, the petitioner is not entitled for grant of bail. In the result, the petition is dismissed. Petitioner is at liberty to file bail petition after filing of final report.
