IN THE HIGH COURT OF ORISSA AT CUTTACK W.P.(C) Nos.11687 & 13267 of 2018 Bharat Bhusan Satpathy and Others …. Petitioners Mr. S.B. Jena, Advocate -versus- State of Odisha and Others …. Opposite Parties Mr. A.K. Mishra, Advocate for O.P. Nos.2 and 3 Mr. S.K. Jee, AGA CORAM: JUSTICE BIRAJA PRASANNA SATAPATHY Order No. ORDER 28.07.2025 09. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode. 2. Heard learned counsel for the parties. 3. In course of hearing, learned counsel for the petitioners in both the case contended that taking into account their long continuance and in view of the decision of the Hon’ble Apex Court in the case of Jaggo Vrs. Union of India and Others as well as Shripal and Anr. vrs. Nagar Nigam, Ghaziabad, petitioners are eligible to get the benefit of regularization. 3.1. It is also contended that in terms of the interim order passed by this Court on 19.07.2018 basing on Annexure-5, no selection process has been initiated as yet to fill up the post on regular basis. It is accordingly contended that petitioners be permitted to withdraw the Writ Petition with liberty to move O.P. No.2 for regularization of their services taking into account the decision in the case of Jaggo and Shripal as cited (supra) 4. In view of such submission made, this Court while disposing both the Writ Petitions, permits the petitioners to move O.P. No.2 for consideration of their claim for regularization. It is observed that if any such application will be moved within a period of 2 (two) weeks from today, O.P. No.2 shall take a lawful decision on the same within a further period of 3 (three) months with due communication. 5. Both the Writ Petitions accordingly disposed of. Photocopy of this order be placed in the connected matter. (Biraja Prasanna Satapathy) Judge Basudev
