JUSTICE PRAMIL KUMAR MATHUR Order 03/03/2025 Heard on the application for staying the judgment of conviction dated 12.09.2024 passed by the learned Trial Court. Counsel appearing on behalf of the applicant argued that the applicant has been falsely implicated in this matter and he is a lecturer and on account of conviction his service has been terminated by the Director, Secondary Education Bikaner vide order dated 02.12.2024. He further argued that the sentence of the applicant has already been suspended by this court vide order dated 17.10.2024 passed in D.B. Criminal Misc. Suspension of [2025:RJ-JP:9026-DB] (2 of 2) [Criminal Misc. Stay-843/2025] Sentence Application No.1619/2024 and prayed for staying the judgment of conviction. Learned GA-cum-AAG as well as counsel for the complainant opposed the submission made by counsel for the applicant. We have perused the material available on record and find that the applicant is a lecturer and his conduct is not appropriate and according to the statements of PW-1 & PW-2, the applicant has actively participated in the alleged incident, therefore, in our considered view, no case is made out for staying the judgment of conviction passed by the learned Trial Court. In that view of the matter, this stay application is dismissed. (PRAMIL KUMAR MATHUR),J (INDERJEET SINGH),J MG/07
