Budh Ram Vs. The H.P. State Cooperative Agriculture & Rural Development Bank Ltd. & Anr. CMP No.352 of 2025 in CWP No.15950 of 2024 06.01.2025 Present: Mr. Rakesh Chaudhary and Mr. Panku Chaudhary, Advocates, for the applicant/petitioner. By way of instant application, prayer has been made on behalf of the applicant-petitioner for extension of time to deposit the loan amount, in terms of judgment dated 21.12.2024 passed by this Court. Though in the case at hand, this Court was prima facie of the considered view that present petition is not maintainable, however, having taken note of readiness and willingness of the applicant-petitioner to deposit the entire loan amount with up-to-date interest, coupled with the no objection given by non-applicant-respondent, this Court disposed of the main petition with the direction to applicant-petitioner to deposit sum of Rs.5,00,000/- by 23.12.2024 and remaining amount within one week i.e. on or before 30.12.2024. Though in terms of aforesaid order, sum of Rs.5,00,000/- has been deposited before 23.12.2024, but remaining amount, which was to be deposited on or before 30.12.2024, has not been deposited. It is averred in the application that on account of financial constraint, second installment could not be deposited. Though there appears to be no justification to grant further time, but by way of indulgence, 15 days’ more time, as prayed for, is granted to the applicant-petitioner to deposit the balance amount, failing which, non-applicant/respondent-Bank would be at liberty to take appropriate steps for recovery of loan amount.
