This Cr|lm'lnal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/A5 and A6, seeking regular bail, in Crime No.364 of 2O24 of Naidupet Police Station, T-lrupati district. 2. A case has been registered against the Petit'lOnerS here|ln and others for the offence pun'IShable under Section 8(c) gf¢fgr-gr-f,6Z riE5- read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short lthe NDPS Act'). 3. Case of the prosecution, in brief, is that, on o9.12.2024, at about 06.00 hours, on receipt of credible information, the Woman Sub-Inspector of Police, Naidupet Police Station, along with her staff and mediators, conducted raid at Railway Station, Naidupet Town and Mandal and found Al to A6 in possession of 25 Kgs of Cannabis (Ganja). The contraband was seized under cover of a mediators report and a case has been registered against the accused. 4. Heard. Perused the record. 5. The petI'tiOnerS/A5 and A6 were arrested on o9.12.2024 and since then they are in judicial custody. The quantity of Ganja allegedly seized from the possession of accused is 25 Kgs. Learned Assistant Public Prosecutor submitted that major portion of investigation has been completed. lt is represented by the learned counsel for the petitioners that the recovery from the possession Of Petitioners and Other accused iS 25 Kgs of the Ganja but the alleged recovery from the possession of the petitioners herein/A5 and A6 is 4 Kgs each, which is not more than 20 Kgs, as such, the alleged contraband falls under the definition of non-commercial quantity. ` ---- 6. ln view of the aforesaid facts and circumstances of the L£ case, thl-s Court is incll'ned to grant bail tot the petitioners/A5 and A6 on the following conditions. i) The petitioners/A5 and A6 shall be released on bail on their executing a personal bond for Rs.10,000/-(Rupees Ten Thousand only) each with two sureties of the ll'ke sum each to the satisfaction of the learned I Additional District and sessions Judge, Nellore, SPSR Nellore district. ii) On release, the petitioners shall appear before the Station House Offl'cer concerned, once in a week i.e., on every Saturday between 10.00 am and O1.00 pm, till fI-ling Of the Charge sheet. 7. Accordingly, the Criminal Petition is allowed. As a sequel thereto, the miscellaneous petitions, if any,pending in this Criminal Petition shall stand closed.
