SREENIVASA REDDY Civil Revision Petition No.437 of 2025 Order: This Civil Revision Petition is filed against the order dated 05.02.2025 passed in lA No.55 of 2025 in OS No.68 of 2021 by the learned I Additional Civil Judge (Senior Division), Nellore, whereby and whereunder the application filed by the petitioner/defendant to summon the Junior Accounts Officer, Electricity Revenue Office Town-I, Janda Veedhi, Kotametta, SPSR Nellore, for production of certain documents relating to the respondent/plaintiff, was dismissed. The respondent herein/plaintiff filed the suit in OS No.68 of 2021 against the petitioner herein/defendant for recovery of money basing on a promissory note. When the said suit was posted for further evidence of the petitioner/defendant, the petitioner/defendant filed lA No.55 of 2025, under Order XVI Rule 5 and Section 151 CPC, to summon the Junior Accounts Officer, Electricity Revenue Office Town-I, Janda Veedhi, Kotametta, SPSR Nellore, for production of service register, educational qualifications and income tax returns of the respondent/plaintiff. The respondent/plaintiff filed counter affidavit stating that previously the petitioner/defendant filed similar petition in another suit i.e. lA No.447 of 2023 in OS No.53 of 2021 on the file of the learned Principal Civil Judge (Senior Division), Nellore and the same 2. 3. SRK, J CRP No,437 of 2025 *T 4- 2 was dismissed on 09.05.2023. The petitioner/defendant, by suppressing the said fact, filed the present petition with false and frivolous allegations. It is further stated that the proposed documents are no way connected or relevant to the subject matter of the present suit. The trial Court, on consideration of the material on record, dismissed the application holding that the proposed documents are 4. not at all relevant to the subject matter of the suit. Aggrieved by the same, the present Civil Revision Petition is filed. Heard. Perused the record. 5. 6. The contention of the petitioner/defendant is that she filed the present application to prove the name, surname, specific particulars of the respondent/plaintiff, which are available in her service register. educational qualifications and income tax returns. A perusal of the material on record goes to show that in the cross-examination of PW.l, she categorically admitted that her surname was differently reflecting when compared with her certificates and the address particulars in the suit on hand. In such circumstances, there is no need of production of her service register or educational qualifications. So far as production of income tax returns of the respondent/plaintiff is concerned, the same would not in any way helpful to decide the disputed debt between the parties, as they indicate the income particulars and payment of tax by the SRK, J CRP No.437 of 2025 3 respondent/plaintiff only. Hence, the so called proposed documents are not at all relevant to the subject matter of the present suit. Further, the application filed by the petitioner/defendant with similar relief in another suit i.e. in lA No.447 of 2023 in OS No.53 of 2021 on the file of the learned Principal Civil Judge (Senior Division), Nellore, was dismissed. Thereafter, the petitioner/defendant has come up with the present application with an intent to drag on the matter for further more time. The trial Court, after taking all the said aspects into consideration, has rightly dismissed the present application and I see no illegality or irregularity in the order passed by the trial Court warranting interference of this Court. The Civil Revision Petition is devoid of merit and the same is liable to be dismissed. 7. Accordingly, the Civil Revision Petition is dismissed. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Civil Revision Petition, shall stand closed.
