Order on Board 04.11.2025
1. This is an o3ce reference.
2. This Court, vide order dated 16.04.2025 passed in MCRC No. 2197 of 2025, while allowing the bail to the applicant, namely, Kamlesh Sao @ Mithun had expressed its trust that the trial Court would make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of six months from the date of receipt of a certi>ed copy of the order, if there was no legal impediment.
3. The learned Judicial Magistrate First Class, Raigarh, District- KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 Raigarh (C.G.) vide his request letter dated 13.10.2025 has requested for grant of three months additional time for concluding the trial.
4. It transpires from perusal of the PUD that despite repeated issuance of summons, bailable warrants, and non-bailable warrants, the presence of prosecution witnesses could not be secured. The reports of process servers frequently indicate that the witnesses were not available at their given addresses or were temporarily out of station, due to which their appearance before the competent Court could not be ensured. It further appears that, owing to the Presiding O3cer being assigned the duties as Principal Magistrate, Juvenile Justice Board, Raigarh, for three days every week, continuous sittings in the present case could not be maintained. Consequently, the progress of the trial has been delayed. In view of the aforesaid circumstances, he has requested for an extension of a further period of three (03) months from the date of expiry of the original period, in order to enable completion of the remaining evidence and to ensure the >nal disposal of the matter.
5. The request appears to be reasonable. The concerned trial Court is
directed to conclude the trial as early as possible, preferably within a further period of three months from today.
6. Accordingly, this CRMP stands disposed o6 with the aforesaid direction.
7. Registry is directed to send a certi>ed copy of this order to the trial Court concerned for necessary information and compliance. Sd/- (Ramesh Sinha)
