p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No.7850 of 2025 Litu @ Debi Prasad Dash @ Das … Petitioner Mr. D.K. Sahoo, Advocate -versus- State of Odisha … Opposite Party Mr. M.R. Patra, Addl. PP CORAM: JUSTICE G. SATAPATHY Order No. ORDER(ORAL) 20.08.2025 01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. This is the 2nd successive bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Marsaghai P.S. Case No.151 of 2024 corresponding to S.T. Case No. 232 of 2024 (G.R. Case No.1556 of 2024) pending in the file of learned Dist & Sessions Judge, Kendrapara, for commission of offences punishable U/Ss. 126(2)/117(2)/118(1)/ 296/109 of BNS, on the allegation of demanding dadabati of Rs.9,00,000/-, but subsequently assaulting the informant by means of an iron pipe. 3. Heard, Mr. Deepak Kumar Sahoo, learned counsel for the petitioner and Mr. M.R. Patra, learned Addl. PP in the matter and perused the record. Mr. Sahoo at the outset informs this Court that this is the 2nd bail application of the petitioner, but no bail p. 2 application is pending before any other forum except this one. 4. The petitioner renews his prayer for bail purportedly under the changed circumstance of examination of the informant-injured, who has not supported the prosecution case. In such view of the matter and after having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioner vis-à-vis the accusations sought to be brought against him and regard being had to the pre- trial detention of the petitioner in custody since 18.08.2024 and keeping in view the inherent right of the accused to be presumed innocent until proven guilty at the trial, this Court without expressing any view on merits, admits the petitioner to bail. 5. Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) only with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it. 7. Accordingly, the BLAPL stands disposed of. 8. Issue urgent certified copy of the order as per Rules. (G. Satapathy) Judge S.Sasmal Designation: Jr. Stenographer
