THE HONOURABLE SRI JUSTICE HARINATH.N WRIT PETITION Nos.29030 and 29032 of 2025
COMMON ORDER: The petitioners are aggrieved by the impugned confirmation orders dated 25.09.2025 and submit that the respondent authorities are trying to demolish the temporary sheds which were erected by the petitioners in their property.
2. It is submitted that the petitioners erected the temporary sheds in their property and the 2nd respondent issued a show cause notice, which was replied by the petitioners, however, the 2nd respondent has issued the confirmation order dated 25.09.2025 by stating that the explanation submitted by the petitioners is not satisfactory and that the temporary asbestos shed has to be removed.
3. The learned standing counsel appearing for the 2nd respondent submits that the explanation submitted by the petitioners was duly considered and it is also stated that the petitioners did not obtain any permission for erection of temporary sheds as such, the impugned proceeds out not to be interfered with.
4. Heard the learned counsel for the petitioners and the learned standing counsel for the 2nd respondent. Perused the material on record.
5. Considering the nature of construction as temporary in nature, the petitioners to submit an application(s) for grant of permission to the 2nd respondent and on receipt of such application the 2nd respondent shall pass appropriate orders. In the meanwhile, there shall be no coercive steps against the petitioners temporary construction.
6. Accordingly, the writ petition is disposed off without costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. ___________________ JUSTICE HARINATH.N
