ORAL ORDER
The present writ petition is filed seeking the following prayer:
"PRAYER WHEREFORE, it is most respectfully prayed that this Hon'ble Court may be pleased to:- I. Issue a writ, order or direction or writ of Mandamus to consider the representation dated 11-04-2025 given by the petitioner found at Annexure - G. II. Issue a writ or order or direction to the respondent Bank to confirm the sale and register the sale deed in favour of petitioner in accordance with law. III. Grant such other order, writ, as this Hon'ble court deems fit in the facts and circumstances of the case including the cost of this writ petition."
2. The facts of the case are that the respondent/Bank has issued E-Auction Sale Notice dated 29.12.2023 and the auction was fixed on 03.02.2024. The husband of the petitioner has contested the said auction and deposited an amount of Rs.8,18,000/-, pursuant to the same, auction had taken place on 03.02.2024, wherein one Mr.M.P.Chandan became successful bidder by bidding an amount of Rs.84,80,000/- and the husband of the petitioner became second highest bidder by bidding an amount of Rs.83,80,000/-. Thereafter, the petitioner challenged the Sale notice dated 29.12.2023 and also confirmation of Bid dated 03.02.2024 by filing

WP.No.5306/2024 before this Court. This Court vide order dated 21.02.2024 had granted an interim order that the proceedings shall remain stayed and further directed the petitioner to pay an amount of Rs.42.40/- lakhs within one week and another sum of Rs.42.40/- lakhs within two weeks. It is stated that as per the order passed by this Court, the petitioners have paid the entire amount. It is also stated that the successful bidder has taken back the entire amount and has withdrawn from the sale. 3. On 02.04.2025, WP.No.5306/2024 was disposed of observing that the petitioners have paid entire amount and they have purchased the property in auction and further liberty was granted to the Bank to proceed further in accordance with law. It is stated that thereafter, the petitioners gave a representation dated 11.04.2025, initially it was not endorsed. But the petitioners' copy was duly acknowledged on 17.07.2025, wherein the petitioners sought the respondent/ Bank to facilitate the registration of schedule property in his name.
But till today, the respondent/Bank has not registered the sale deed in favour of the petitioners. In spite of several requests, the Bank is not completing the procedure. Hence, the

petitioners have come up before this Court by filing the present writ petition. 4. Learned counsel appearing for the respondents/Bank submits that the first highest bidder has already taken the amount back and it is submitted that the entire amount is paid by the petitioner. 5. In that view of the matter, this Court is passing the following:
ORDER i. The respondent/Bank shall register the Sale Certificate in favour of the petitioners in accordance with law. ii. Accordingly, the writ petition is disposed of. iii. All I.As. in this petition shall stand closed.
