GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... to issue an order or a direction or a writ, more particularly one in the nature of Writ of Mandamus declaring the action of 2 the Respondent Nos. 4 and 5 in interfering with the possession of the Petitioner over his house situated in bearing D. No. 3-8- 31/9, present bearing D. No. 10/8/49/1 situated at Ramalayam Street, Allagadda Town, Nandyal District at the instance of the unofficial Respondent Nos. 6 and 7, particularly when a suit in O.S. No. 30/2022 on the file of the Learned Junior Civil Judge Court, Allagadda is pending between the Petitioner and unofficial respondent Nos. 6 and 7 as illegal, arbitrary and unconstitutional, and to consequently direct the Respondent Nos. 4 and 5 not to interfere with the possession of the Petitioner over the above stated property.” 2. Heard Sri Mulla Sohail Shareef, learned counsel for the petitioner and Sri Md.Farooq, learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioner would submit that the police are interfering in the civil disputes between the petitioner and unofficial respondents. 4. Learned Assistant Government Pleader for Home would submit that the police are not interfering in the civil disputes between the parties. Learned Assistant Government Pleader for Home would further submit that based on the complaint given by respondents 6 and 7 in PGRS, the petitioner was called to the police station for preliminary enquiry and no crime has been registered against the petitioner. 5. Recording the said submissions, the Writ Petition is disposed of. However, the police are directed not to interfere in the civil disputes between the parties except under due process of law. There shall be no order as to costs.
