Earlier prayer for bail of the petitioner was lastly rejected on merits vide order dated 12.07.2024 passed in B.A. No.3708 of 2024 wherein direction was given to the learned Trial Court to conclude the trial within six months, thereafter the petitioner will be at liberty to renew his prayer for bail. Petitioner above-named who is in custody has renewed his prayer before this Court for grant of regular bail in connection with S.T. No.990 of 2022 arising out of Mandar [ Ranchi] P.S. Case No.145 of 2022 registered under Sections 302 & 201/ 34 of the Indian Penal Code. Heard the parties. It is submitted by learned counsel for the petitioner that the petitioner has renewed his prayer for bail on the ground that vide order dated 12.07.2024 passed in B.A. No.3708 of 2024, direction was given to the learned Trial Court to conclude the trial within six months, thereafter the petitioner was at liberty to renew his prayer for bail. Out of seven charge- sheeted witnesses, only three witnesses have been examined and the petitioner is in custody since 04.09.2022, as such, this Court may consider the same. Learned APP for the State has vehemently opposed the prayer. Considering the submissions of learned counsel and the fact as discussed above, the bail application is allowed. Accordingly, the petitioner named above shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below subject to the condition that one of the bailor(s) must be close relatives of the petitioner.
