The present Application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant-Vikram Singh Rawat seeking anticipatory bail in Case Crime No.16 of 2025, registered at Police Station Nehru Colony, District Dehradun. 2. The investigation is pending for the offence under Sections 406, 420, 467, 468 and Section 471 of the Indian Penal Code, 1860. 1 2025:UHC:5624 3. As per the First Information Report dated 10.01.2025, the informant-Ranvir Singh Chauhan and the informant-Shubham Chandel are the treasurer and vice- president respectively in Panesia Hospital Management Society. The present applicant was the secretary of the said Society till 31.07.2024. His resignation was accepted on 31.07.2024. Later, on enquiry, it was found that he along with his wife had embezzled lakhs of rupees from the Society. 4. Heard Mr. Ramji Srivastava, learned counsel for the applicant, Mr. Pradeep Lohani, learned Brief Holder for the State and Mr. Lalit Sharma, learned counsel for the informant. 5. Mr. Ramji Srivastava, Advocate contended that a dispute arose between the applicant and other members of the Society. The applicant expressed his wish to exit from the Society vide his letter dated 31.07.2024. The Chartered Accountant did not find any embezzlement. The informants being the members of the Society malafidely lodged the First Information Report. 6. Mr. Ramji Shrivastava, Advocate, further submitted that the applicant is a permanent resident of District Dehradun. Therefore, there is no chance of his 2 2025:UHC:5624 absconding. He is not a convicted person. He was granted interim bail on 07.04.2025 and the conditions of interim bail have not been violated by him. 7. Mr. Pradeep Lohani, Brief Holder and Mr. Lalit Sharma, Advocate, have opposed the anticipatory bail application. 8. Having heard the submissions of learned counsel for the parties and keeping in view of the facts and circumstances of the case, without commenting on the merits of the case, the present Application, filed for anticipatory bail, is allowed and order dated 07.04.2025, granting interim bail to the applicant, is made absolute. It is directed that in the event of arrest of the applicant Vikram Singh Rawat, he shall be released on anticipatory bail on executing a personal bond of Rs. 30,000/- and two reliable sureties, each of the like amount, to the satisfaction of the Arresting Officer, subject to the following conditions:- (i) Applicant shall cooperate with the Investigating Agency and he shall make himself available for interrogation by a police officer as and when required; (ii) If the charge-sheet is filed, the applicant shall attend the trial court regularly and he shall not seek any unnecessary adjournment; 3 2025:UHC:5624 (iii) Applicant shall not directly or indirectly make any inducement, threat or promise to any person, acquainted with the facts of this case; (iv) Applicant shall not leave the country without the previous permission of the trial court. 9. It is made clear that if the applicant misuses or violates any of the conditions, imposed upon him, the prosecution agency will be free to move the Court for cancellation of the anticipatory bail. ___________________ ALOK KUMAR VERMA, J.
