ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
“…to issue a writ of mandamus, or any other appropriate writ, order or direction, declaring the action of the respondents in withholding the payment of bills amount of Rs.42,23,573.67 in relation to the work i.e., “construction of new office building in the place of existing dilapidated condition in Market Yard, Repalle A.M.C., Repalle in Bapatla District vide Agreement No.287 / 2023-24, dated 5.2.2024”, as illegal and arbitrary apart from violative of Articles 14, 16, 19 and 300-A of the Constitution of India and consequently direct the respondents to consider for payment of bill amount of Rs.42,23,573.67 with an interest @ 24% per annum for the delayed amount to the petitioner in respect of execution of above-mentioned work, forthwith….”

The learned Standing Counsel for A.M.C. representing the respondents placed on record the written instructions of the Special Grade Secretary (F.A.C.), Agricultural Market Committee, Repalle, dated 15.07.2025 and submitted that the bill of the work ‘construction of new office building in the place of existing building in dilapidated condition in MY Repalle’ was submitted within time in the CFMS portal vide C.F.M.S. Bill No.2024-2252992 dated 31.01.2025 for Rs.44,37,246.67 paise and there is no delay from A.M.C., Repalle and the bill was returned by C.F.M.S. to D.D.O, A.M.C,, Repalle, and that again the bill was re- submitted in the C.F.M.S. portal for the financial year 2025-2026 vide C.F.M.S. Bill No.2025-986455 dated 09.07.2025 for Rs.71,05,609.64 paise and the bill is pending with C.F.M.S.

03. The learned counsel for the petitioner requested to pass appropriate order giving reasonable time to the respondents to finally make the payment. 04. In view of the admitted liability and the fact that bills are pending with the respondents, the writ petition is disposed of directing the respondents to release the total amount under the aforesaid bills within two (02) months from the date of receipt of copy of this order.
