ORAL ORDER This petition is filed by the petitioner under Section 482 of Bharatiya Nagrika Suraksha Sanhita, 2023 praying to grant anticipatory bail in Crime No.339/2025 of Whitefield CEN Crime Police Station registered for offences punishable under Sections 318(4) and 319(2) of Bharatiya Nyaya Sanhita, 2023 read with Section 66(D) of Information Technology Act.

2. Heard the learned counsel for petitioner and learned High Court Government Pleader for respondent - State.

Learned counsel for petitioner would contend that, the petitioner is running M/s. SLN Facility Management Services and he provides manpower for different work to the individuals who are in need and he has been falsely been harassed by the police. He further submits that, the police have issued notice to the petitioner and therefore, he apprehends his arrest. He submits that no amount has been credited to the account of the petitioner herein. In spite of that, his account has been freezed. He further submits that, the petitioner is ready to cooperate with the police in investigation and abide by any terms and conditions to be imposed by this Court. With these, he prayed to allow the petition. 4. Per contra, learned High Court Government Pleader would contend that, there are thirty nine (39) cases registered against the petitioner in different States. - 4 -

The petitioner is involved in commission of online fraud wherein, the complainant has invested Rs.43,86,652/- and got back only Rs.1,40,500/-. The complainant has been cheated. The petitioner is required for custodial interrogation. With these, he prayed for dismissal of the petition. 5. Having heard the learned counsels appearing for the parties, the Court has perused FIR, complaint and other materials placed on record. 6. The complainant - Sri. Halappa B. stated to have invested Rs.43,86,652/- in Financial Share Trading with 'High End Think Tank' and he got back only Rs.1,40,500/-. When the complainant insisted for the payment of remaining amount invested by him, the concerned persons stated to have asked the petitioner to deposit more money to get back his amount of investment. In the complaint, the complainant has disclosed all the details of accounts from which he has transferred to the different accounts. The name of the

petitioner is not forthcoming in the averments of the complaint and in the FIR. The petitioner is stated to have been a proprietor of M/s. SLN Facility Management Services and what is the exact role of the petitioner herein in the online fraud stated to have been committed against the complainant is required to be ascertained only after investigation and trial. The offences alleged against the petitioner are not punishable either with death or imprisonment for life.
The petitioner has undertaken to cooperate with the police in investigation and abide by any terms and conditions to be imposed by this court. 7. Considering all the above aspects, the petitioner has made out a case for grant of anticipatory bail with conditions. In the result, the following;
ORDER This Criminal Petition is allowed. The petitioner is granted anticipatory bail in Crime No.339/2025 of Whitefield CEN Crime Police Station and is ordered to be

released on bail in the event his arrest, subject to following conditions: i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the likesum to the satisfaction of the Investigating Officer. ii) The petitioner shall voluntarily appear before the Investigating Officer within 15 days from this day and execute bail bond and furnish surety. iii) The petitioner shall cooperate with the Police in investigation and make himself available for interrogation whenever required. iv) The petitioner shall not threaten the prosecution witnesses either directly or indirectly. v) The petitioner shall mark his attendance in the Jurisdictional Police Station on every Sunday between 10:00 a.m. to 2:00 p.m. for a period of two months or till the filing of final report whichever is earlier.

vi) The petitioner shall not commit any offence. The prosecution is at liberty to move for cancellation of bail if petitioner is found involved in any case.
