This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been 3led by the applicant, who is apprehending his arrest in connection with Crime No. 215/2025 registered at Police Station – Excise Circle Jaijaipur, District – Sakti (C.G.) for the o8ence punishable under Section 34(2) of the Chhattisgarh Excise Act. 2. The learned counsel for the applicant seeks permission of this Court to withdraw this instant bail application, with the liberty to file RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI 2 afresh, as in fact the First anticipatory bail application of the applicant had already been rejected by this Court in MCRCA No.1176/2025 on 04.08.2025, and in fact that the present bail application is termed with “First Anticipatory Bail application”, though it is the Second Anticipatory Bail Application, and further the same also suffers from various defects. 3. Learned counsel for the respondent/State has no objection. 4. Permission is granted. 5. Accordingly, the instant application is dismissed as withdrawn with liberty to file afresh termed with “Second Anticipatory Bail Application”, subject to depositing a sum of Rs.5,000/- as cost by the applicant in the Registry of this Court within a period of one week from today and the same shall be transmitted to the Government Home for Mentally Underdeveloped Children, Mana Camp, Raipur. 6.
