List revised, none appears on behalf of petitioner, however, learned Standing counsel for the State is present. A notice has been placed on the notice board specifically, mentioning that
"old cases up to the year 2022 shall be taken up in the first round itself. In case of non-appearance, matter shall be dismissed as infructuous or otherwise, and in the cases, where the cause of action still survives, the concerned advocates are expected to mark them accordingly in the cause list. Failure to do so, may result in its dismissal as infructuous" but, neither the counsel for the appellant has appeared nor has the case been marked to indicate that the cause of action still survives. Perused the record. The petition has been filed with the prayer to quash the order dated 26.11.2014 whereby claim of payment of gratuity of the petitioner has been rejected and information about which has been given by the order impugned and the same has been rejected on a number of occasions. Earlier the petitioner had filed a writ petition bearing no. 54056 of 2012 which was disposed of by order dated 15.10.2012 directing the District Basic Education Officer, Meerut, to consider the claim of the petitioner regarding payment of gratuity amount as she had opted for voluntary retirement. From the order impugned it is clear that the aforesaid has been rejected on a number of occasions mentioning the grounds therein. challenging the order vide which communication has been made to the petitioner regarding rejection of his claim. Learned Standing Counsel submits that the petitioner is not entitled for the relief, as prayed. In view of settled controversy as well as even otherwise it appears that the petitioner has lost interest, as if nothing survives. Accordingly the petition is dismissed.
