PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 20231 by the Petitioner/Accused No.2 for granting of pre-arrest bail in connection with Crime No.196 of 2025 of Anakapalli Rural Police Station, Anakapalli District, registered for the alleged offences 1 the BNSS 2 punishable under Sections 288 of the Bharatiya Nyaya Sanhita, 20232 and 4, 5 and 6 of the Explosives Substances Act, 19083. 2. Heard the learned Counsel for the Petitioner and the learned Assistant Public Prosecutor. 3. As seen from the record, based on the confession of Accused No.1, Accused No.2 was added in this case. Accused No.1 was already enlarged on bail by the learned Trial Court in Crl.M.P.No.111 of 2025 on 14.11.2025. Accused No.3 was also granted anticipatory bail. The Petitioner/Accused No.2 is a licensed dealer in explosive substances, holding a valid licence up to 31.03.2028. Accused No.3, for whose benefit the alleged explosive substances were sold and allegedly used, has already been enlarged on pre- arrest bail by the learned Trial Court. 4. Considering the facts and circumstances of the case, the gravity and nature of the allegations levelled against the Petitioner/Accused No.2, this Court is inclined to grant pre-arrest bail to the Petitioner/Accused No.2. 5. In the result, the Criminal Petition is allowed with the following conditions: i. In the event of arrest of the Petitioner/Accused No.2 he shall be enlarged on bail subject to his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only), with two sureties for the like sum each to the satisfaction of the arresting police officials; ii. The Petitioner/Accused No.2 shall make himself available for investigation as and when required; iii. The Petitioner/Accused No.2 shall not cause any threat, inducement or promise to the prosecution witnesses; 2 the BNS 3 the Act 3 iv. The Petitioner/Accused No.2 shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet. v. The Petitioner/Accused No.2 shall not leave the State of Andhra Pradesh limits without the express permission from the Station House Officer concerned. vi. The Petitioner/Accused No.2 shall surrender their passport, if any, to the investigating officer.
