ORAL ORDER Learned HCGP takes notice for respondents No.1 and 2. Notice to respondent No.3 is not necessary for the following reasons:

Sri Arun Kumar K., learned Senior Counsel appearing for the petitioners submits that the petitioners are aggrieved of the order of conversion at Annexure ‘A’ dated 18.02.2015 passed by the Deputy Commissioner, Bengaluru Urban District. At the outset, it is submitted that the petitioners will have to question the impugned
order of conversion before the Karnataka Appellate Tribunal and therefore, liberty is sought to approach the Tribunal.

However, learned Senior Counsel submits that the private respondent No.3 herein has obtained the order of conversion although the lands in question were sold in favour of a third party who has formed a layout after obtaining an order of conversion and the petitioners herein have purchased residential sites are aggrieved by virtue of the impugned conversion order which the third respondent is using to create problems for the petitioners.
4. Accordingly, the writ petition stands disposed of reserving liberty to the petitioners to approach the Karnataka Appellate Tribunal, questioning the impugned
order of conversion. If the appeal is filed along with an application for condonation of delay, the Tribunal shall take note of the facts and circumstances under which the petitioners are now approaching the Tribunal and pass orders accordingly.
