1. Heard learned counsel for the respective parties.
2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioner.

Perused the copy of the FIR made available to the Court by learned counsel for Vigilance Department with a memo filed today and it reveals that there has been defalcation of an amount of Rs.7,30,087/- in connection with excavation of a tank. The petitioner is alleged to be the PEO and his involvement is alleged along with others. Learned counsel for the petitioner submits that the co-accused persons, namely, Simanchal Purohit and Dillip Kumar Rout are on bail by the Court’s orders dated 15th January, 2026 and 19th January, 2026 in ABLAPL Nos.230 of 2026 and 352 of 2026 and the petitioner is on similar footing and hence, he should be released on bail.

Learned counsel for the Vigilance Department produced a copy of a letter received from the DSP (Vigilance), Balangir with an intimation therein that the petitioner has appeared before the Unit Office on 23rd December, 2025 pursuant to the order dated 23rd December, 2025 of this Court.

Considering the same and release of the co-accused persons on bail and in view of the instruction shared with the Court regarding appearance of the accused on 23rd December, 2025 extending cooperation in the enquiry, this Court is inclined to direct his release in connection with Sambalpur Vigilance P.S. Case No.27 dated 28th December, 2025 corresponding to Vig. G.R. Case No.14 of 2025 with suitable conditions imposed upon his appearance before the learned court below.
6. Accordingly, it is ordered.
7. In the result, ABLAPL stands disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner on his appearance moves an application in connection with Sambalpur Vigilance P.S. Case No.27 dated 28th December, 2025 corresponding to Vig. G.R. Case No.14 of 2025 within a fortnight from today, it is directed that he shall be released on bail by the court of learned Special Judge (Vigilance), Balangir, who shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, he shall continue cooperating the I.O. in the investigation of the
case and appear before the Vigilance P.S. as and when necessary, till the enquiry/investigation is concluded.
