Order on Board 07.11.2025
1. This is an o5ce reference.
2. This Court, vide order dated 14.10.2025, passed in MCRC No. 3368 of 2025, while allowing the bail of the petitioner, namely, M. Harshvardhan Reddy, had expressed its trust that the trial Court should make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of six months from the date of receipt of a certi>ed copy of the order, if there was no legal impediment.
3. The learned Judicial Magistrate First Class, Durg District-Durg KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 (C.G.) vide his request letter dated 14.10.2025 has requested for grant of some more time for concluding the trial.
4. It transpires from perusal of the PUD that upon examination of the proceedings, it is evident that although the accused was released on bail pursuant to the order of this Court, he has consistently failed to appear before the trial Court thereafter. His application under Section 317 CrPC was rejected and repeated arrest warrants have been issued on every subsequent date, yet none could be executed due to the accused absconding. As a result, the case has been repeatedly listed only for securing his presence and no progress toward the stage of framing of charge or further trial could be made. In view of the continued non appearance of the accused and the pending execution of the arrest warrants, the trial Court has sought an extension of time for the proper and lawful conclusion of the proceedings.
5. The request appears to be reasonable. The concerned trial Court is
directed to conclude the trial as early as possible, preferably within a further period of four months from today.
6. Accordingly, this CRMP stands disposed o4 with the aforesaid direction.
7. Registry is directed to send a certi>ed copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
