And 3 Others Counsel for Petitioner :- Arvind Kumar Trivedi Counsel for Respondent :- C.S.C.,Sanjay Kumar Dubey Hon'ble Ajay Bhanot,J. The petitioner is the sister of the deceased-employee. She claims that dues like EL, gratuity, DA and PF of her deceased unmarried brother have not been paid till date. She has made a representation before the competent authority claiming entitlement to the same but to no avail. The only prayer made by Shri Arvind Kumar Trivedi,
learned counsel for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time. Shri Sanjay Kumar Dubey, learned counsel for the respondent Nos.3 and 4 submits that the matter requires determination of facts by the competent authority in light of the applicable provisions of law in the first instance. The other legal heirs of the deceased-employee are also liable to be noticed. However, he fairly contends that the claim for payment of dues of her deceased-brother is liable to be decided by the competent authority in a reasonable time frame. In wake of the submissions made at the Bar and without
going into the merits of the case, the respondent No.4- Executive Officer, Nagar Palika Parishad, District-Hathras is directed to decide the representation of the petitioner regarding payment of dues like EL, gratuity, DA and PF of her deceased-brother, after determining the genuineness of the credentials of the petitioner and noticing all other legal heirs of the deceased-employee in accordance with law within a period of four months from the date of receipt of a certified copy of this order along with a fresh copy of the representation.
