The present revision petition has been preferred under Article 227 of the Constitution of India seeking issuance of a direction to the Court of learned Civil Judge (Junior Division), Jagraon to decide the application filed by the respondents/plaintiff under Order 39 Rules 1 and 2 of the Code of Civil Procedure, 1908 (for short ‘CPC’) for the grant of ad interim injunction. 2. A suit for declaration was filed by the respondents/plaintiffs (Gurjit Singh and Kulwinder Kaur) against the petitioner/defendant (Charanjit Kaur and three others). On 29.09.2020, an interim order was passed restraining the present petitioner from transferring the suit property in any manner except in due course of law. It is the case of the petitioner that since then, the application under Order 39 Rules 1 and 2 CPC is pending and the same has not been disposed of. 3. Learned counsel representing the petitioner submits that for the last about one year, the plaintiff is not even putting in appearance before the trial Court. Learned counsel has referred to the orders dated 23.05.2024 onwards wherein it had consistently been so recorded. Without further going into the issue, the present revision petition is disposed of with a direction to the Court of learned Civil Judge (Junior Division), Jagraon, where Civil Suit No.888 of 2020 titled as ‘Gurjit Singh Vs. Charanjit Kaur’ is pending, to dispose of the application under Order 39 Rules 1 and 2 CPC within a period of one month from the next date of hearing i.e. 01.05.2025.
