This petition is filed by accused No. 1 under Section 438 of Cr.P.C. (482 of Bharatiya Nagarik Suraksha Sanhita, 2023) seeking grant of anticipatory bail in crime number 221/2025 of Kodigehalli Police Station registered for offences punishable under Sections 420, 504, 506, 34 IPC. 2. Heard learned counsel for petitioner and learned Additional SPP for respondent - State. 3. Learned counsel for petitioner would contend that the accusation against the petitioner is that he collected money from different persons and also from first informant promising to get them a government job. Said allegation of collecting money is of the year 2002 and FIR is filed in the year 2025 and there is delay in filing - 3 - HC-KAR NC: 2025:KHC:41411 CRL.P No. 13994 of 2025 complaint. The accusations against the petitioner are all false allegations. The first informant is aged about 40 years and he is not of the age of getting a government job. The petitioner was arraigned as accused in Crime No. 31/2024 for similar allegation, investigation has been completed in the said case, he has been granted bail and he is appearing in the criminal case registered in that crime. Petitioner apprehends his arrest as he has been served with a notice to appear before the Investigating Officer for investigation. Petitioner is aged 60 years, unable to walk and attend to his daily routine. The offence alleged against the petitioner is not punishable either with death or imprisonment for life. Petitioner is ready to cooperate with the Police in the investigation and abide by terms and conditions to be imposed by this Court. With this, he prayed to allow the petition. 4. Per contra, learned Additional SPP would contend that there are serious allegations against the petitioner and his wife of collecting huge cash and money - 4 - HC-KAR NC: 2025:KHC:41411 CRL.P No. 13994 of 2025 through their accounts from 70 persons. Petitioner and his wife promised those persons to get government jobs and cheated them. Petitioner, in spite of being served with notice twice, has failed to appear before the Investigating Officer for interrogation. Therefore, petitioner is not entitled for grant of bail as he is required for custodial interrogation. With this, she prayed for dismissal of the petition. 5. Having heard learned counsel for the parties, this Court has perused the FIR, complaint and other materials placed on record. 6. On the first information filed by one Hanamanth case came to be registered against the petitioner and others in crime No. 221/2025 of Kodigehalli Police Station for offence punishable under Sections 420, 504, 506, 34 IPC. The accusation against the petitioner – accused No. 1 and others in the said first information filed by one Hanamanth is that the petitioner and other accused promised 70 persons to get them government jobs and - 5 - HC-KAR NC: 2025:KHC:41411 CRL.P No. 13994 of 2025 cheated them by not providing government jobs. The offence alleged against the petitioner is not punishable with either death or imprisonment for life. Petitioner, in crime No. 31/2024, on similar allegations, had been taken into custody by CCB, Bengaluru, and after investigation has appeared in the said case and he has been granted bail. Petitioner has undertaken to cooperate with the Police in the investigation and abide by conditions to be imposed by this Court. Considering the above aspects, petitioner has made out grounds for grant of anticipatory bail with conditions. 7. In view of the above, the following; O R D E R Petition is allowed. Petitioner is ordered to be released on bail in the event of his arrest in crime No. 221/2025 of Kodigehalli Police Station, subject to the following conditions: - 6 - HC-KAR NC: 2025:KHC:41411 CRL.P No. 13994 of 2025 I. Petitioner – accused No. 1 shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the Investigating Officer. II. Petitioner – accused No. 1 shall appear before the Investigating Officer within 10 days from this day and execute bail bond and furnish surety. III. Petitioner – accused No. 1 shall cooperate with the Police in the investigation. IV. Petitioner – accused No. 1 shall appear before the Investigating Officer whenever called for. V.
