2 ORDER:
The present Writ Petition, under Article 226 of Constitution of India, is filed by the petitioner seeking the following relief:
<…..to issue an appropriate Writ, Order or direction more particularly one in the nature of a Writ of Mandamus declaring the inaction on the part of the respondent No.2 in re-issuing the Passport in my favour by considering the Application in Application Reference No.25-1062312473, citing the pendency of the crimes in Cr.No.07 of 2016 on the file of the Uyyalawada P.S. and Cr.No.305/2018 on the file of the Jammalamudugu P.S., despite after bringing to his notice that, the police authorities after due enquiry referred the aforementioned crimes as false vide SDPO Orders, dated 30.06.2017 and 21.05.2019 respectively and the well established legal principles laid down by this Hon’ble Court as well as the Hon’ble Apex Court from time to time apart from being violative of the fundamental rights guaranteed to me under Articles 14, 19 and 21 of the Constitution of India and consequently direct the respondent No.2 to reissue the passport issued in my favour for a further period of 10 years by considering the application in Application Reference No.25-1062312473 and pass …=

2. The petitioner is the holder of Passport bearing No.P2115525, which is going to expire on 09.05.2026. As the petitioner is intending to attend a business trip at Vietnam on 24.11.2025, and as his passport is going to expire within six (6) months from the date of travel, on 28.09.2025, the petitioner has made an application vide Reference No.ARN 25-1062312473 for renewal of his passport before the 2nd respondent.
The 2nd respondent has not renewed the petitioner’s passport due to an adverse police verification report stating that he is involved in Crime No.07 of 2016, registered for the offences under Sections 509, 506 and 427 R/w.34 IPC on the file of Uyyalawada Police Station and Crime No.305 of 2018, registered for the offences under Sections 407 and 420 R/w.34 of IPC on the file of Jammalamadugu Police Station. 3. Sri D. Vigneshwar Reddy, learned counsel for the petitioner, submits that the concerned Police after due verification referred the aforesaid two Crimes as false vide orders of the Sub-Divisional Police Officer, Allagadda in C.No.182/Referral/SDPO-ALG/2017, dated 30.06.2017, and Sub-Divisional Police Officer, Jammalamadugu in R.C.No.52/SDPO-JMD/2019, dated 21.05.2019, and prayed to allow the Writ Petition. 4. Sri P. Ajay Babu, learned Assistant Government Pleader for Home, appearing on behalf of the respondent Nos.3 and 4, on instructions, submits that in both the Crimes, pending against the petitioner, the concerned Police after verification referred the same as false and did not dispute the same. In view of the facts and circumstances and the submissions of both the learned counsel, taking into consideration that the fact that both the Crimes, pending against the petitioner, after due verification by the concerned Police, were referred as false, the Writ Petition is disposed of, at the stage of admission, directing the 2nd respondent to forthwith renew/reissue the passport of the petitioner as per the Rules, within four (4) weeks from the date of receipt of a copy of this order.
