1. Heard.
2. By the present application, the applicant / wife seeks transfer of the proceeding initiated by the non-applicant / husband under Hindu Marriage Act for divorce. The prayer clause “B” of the application reads as under,
“B) Grant this Misc. Civil Application thereby transferring the proceedings of Petition No.A-84/2023 pending on the file of the learned Family Court, Jalna to Civil Judge, Senior Division, Majalgaon and for that prupsoe issue necessary orders;”
3. The learned counsel for the applicant submits that the applicant resides 25 Kms. inside the interiors of Majalgaon, which is at about 150 Kms. away from Jalna. As such, the applicant prays Page 1/3 2025:BHC-AUG:23000
2 mca2.2025 that the proceeding at Jalna be transferred to Majalgaon, as she would not be able to defend the proceeding at Jalna. The learned counsel submits that the applicant resides with her father and there is no independent source of income. The husband is running a medical shop and he would be able to conduct the proceeding at Majalgaon. The learned counsel further submits that the applicant undertakes that in the event the proceeding is transferred to Majalgaon, she would not take unnecessary adjournments and would inform the non-applicant well in advance in the event of adjournments being prayed and would also co-operate in expeditious disposal of the proceeding.
4. Per contra, the learned counsel appearing for the non- applicant / husband opposes the request for transfer of proceeding and submits that the proceeding is filed in the year 2023 and is pending for substantial period at Jalna.
5. Considering the rival submissions of the parties, the present application is allowed in terms of prayer clause “B”. However, it is directed that the proceeding on being transferred shall be decided as expeditiously as possible and that the applicant would not seek unnecessary adjournments in the matter. Page 2/3
