ORAL ORDER
In this petition, petitioners have sought for the following relief:-
“WHEREFORE, it is just necessary in the interest of justice, that this Hon'ble court may be pleased to quash the entire proceedings in C.C. No.10024/2025 (Crime No.10/2025) under section 85, 115(2), 351(2), 352 r/w 3(5) of IPC and also under Sections 3 & 4 of Dowry Prohibition Act against the petitioners which is pending before XXIV ACJM, at Bangalore in so far as petitioners are concerned and pass such other order's as this Hon'ble court may be deems fit and proper in the circumstances of the case.”

Learned counsel for the petitioners – accused Nos.1 to 3 has filed a Joint Affidavit duly signed by the petitioners, 2nd respondent and petitioner’s counsel and the same is taken on record. 3. Petitioners – accused Nos.1 to 3, respondent No.2 and their counsel are physically present before the Court and they admit the contents of the Joint Affidavit, which reads as under:-
“JOINT AFFIDAVIT
We, I SRI. VISHNU PRASAD RS/o Sri. Rajendra Prasad, aged about 28 years, 2. SMT. NAVANEETHAW/o Sri. Rajendra Prasad, aged about 58 years, 3. SRI. RAJENDRA PRASAD, S/o Sri. Ansiraj, aged about 59 years, all are residing at No.4, Sampige Street, 1 Cross, Bagiratha Layout, Kengeri Satellite Town, Bangalore-560060 and SMT. V. SINDHU W/o Sri. Vishnu Prasad R, aged about 29 years, residing at No. FF 101, A Block, Mars Classic Apartment, Kenchenahalli Main Road, Rajarajeshwari nagar, Bengaluru- 560098, do hereby solemnly affirm and state on oath as follows:
1. We state that the petitioner No.1 is the husband and respondent No.2 is the wife and our marriage was solemnized on 12.03.2023 and later due to irreconcilable difference and non-compatibility of temperaments, we are living separately. Thereafter, the respondent No.2 i.e., the

wife of Petitioner No.1, has initiated a divorce petition in M.C.No.5917/2024 before the Hon'ble II Additional Principal Judge Family Court at Bangalore. 2. We state that the respondent No.2 has also initiated proceedings in C.C. No.10024/2025 (Crime No.10/2025)under section 85, 115(2),351(2),352 r/w 3(5) of IPC and also under section 3 & 4 of Dowry Prohibition Act before the XXIV ACJM, at Bangalore and wherein I the petitioner No.1 is the husband of respondent No.2 and we the petitioner No.2 and 3 are the mother and father of the petitioner No.1 respectively. 3. We state and submit that we have settled the matter in M.C.No.5917/2024 by a memorandum of settlement agreement before the mediation and arrived at a conclusion that the Petitioner No.1 shall pay a sum of Rs. 10,00,000/- in towards full and final settlement of all claims in which Rs.5,00,000/- shall be paid during the settlement M.C.No.5917/2024 and remaining amount of Rs.5,00,000/- shall be paid before this Hon'ble High Court after the quashing of criminal proceedings in C.C. No.10024/2025 and the Petitoner No.1 had returned One Gold Ring, Silver Diya, Kia Sonet car, educational documents, medical documents, utensils, cloths etc.
to the Respondent No.2. 4. We state and submit that, the petitioner No.1 has issued a DD bearing No.292643, dated. 15.04.2025, drawn on Canara Bank, Kengeri Satellite Town Branch, Bengaluru

in favor of respondent No.2 and the respondent No.2 has returned the 1 Gold Chain to the petitioner No.1. 5. I the respondent No.2 state that I have agreed to co-operate in quashing of the proceedings in C.C. No.10024/2025 pending on the file of XXIV ACJM, at Bangalore before this Hon'ble court and I the respondent No.2 has no objection to quash the said proceedings. 6. We state and submit that in view of the said settlement, we pray that this Hon'ble court be pleased to quash the proceedings in C.C.No.10024/2025pending on the file of XXIV ACIM, at Bangalore as I the respondent No.2 received the said amount as full and final settlement. We swear that this is our name and signatures and the contents of this joint affidavit are true and correct.”
4. In view of the aforesaid settlement entered into between the petitioners and 2nd respondent, I pass the following:
ORDER (i) The petition is disposed of in terms of Joint Affidavit dated 08.07.2025. (ii) The proceedings in C.C.No.10024/2025 (arising out of Crime No.10/2025 of 1st respondent – Police) registered for the offences punishable under Sections 85, 115(2), 351(2), 352 read

with Section 3(5) of IPC and Sections 3 and 4 of Dowry Prohibition Act, pending on the file of XXIV ACJM, Bengaluru, insofar as the petitioners are concerned are hereby quashed.
