Order 24/03/2025
1. By way of filing this letter petition, a prayer has been made for issuing directions to the respondents for releasing the retiral dues to the petitioner.
2. The contents of the letter petition indicate that the petitioner stood retired on 31.12.2002 after attaining the age of superannuation. When retiral dues were not released to the petitioner, he approached this Court by way of filing this letter petition.
(2 of 2) [CW-7192/2003]
3. Reply to the letter petition has been submitted by the respondents, which indicates that the general provident funds, commutation of pension, gratuity and leave encashment amount has been paid to the petitioner in the month of April and May, 2003 and lastly in the month of December, 2003. Counsel submits that there was discrepancy in the record with regard to date of birth of the petitioner. Counsel submits that the correct date of birth of the petitioner was 22.12.1944, but the same was mentioned as 22.12.1948. Counsel submits that the petitioner was
directed to furnish the Secondary School Examination Certificate, but when the same was not provided, the verification with regard to his date of birth was done from the scholar register of the concerned school, hence, under these circumstances, slight delay has occurred in releasing the retiral dues to the petitioner. Counsel submits that under the changed circumstances, this petition has become infructuous, as the relief sought for, has already been granted.
4. Considering the above factual aspect of the matter, the instant writ petition stands dismissed as having become infructuous. Pending applications, if any, also stand dismissed.
