Heard Sri Ved Byas Mishra, learned counsel for petitioners and Sri Ashish Kumar Gupta, holding brief of Sri Pranjal Mehrotra, learned counsel for respondents. 2. The petitioners were employee of Pradeshik Co-operative Dairy Federation Ltd. All the petitioners have taken advantage of VRS scheme dated 24.09.2015 and their applications are allowed. 3. Learned counsel for petitioners submits that all petitioners are aggrieved that they were not paid salary towards the period of notice of three months. 4. Per contra, learned counsel for respondent has referred paragraph Nos. 20 and 21 of counter affidavit, which is reproduced hereinafter :- "20. That the contents of paragraph no. 17 of the writ petition, as stated, are not admitted. In reply, it is respectfully submitted that the petitioners had filed the forms of Voluntary Retirement in accordance with the provisions mentioned in Voluntary Retirement Schemes dated 30.09.2015 and 24.09.2015 issued by the PCDF, and in the Scheme dated 30.09.2015, in paragraph no. 3, it is clearly mentioned that "ककारररककों ससे 31 अक्टटबर 2015 तक ववीआरएस आवसेदन पत्र आरमंरत्रत रकयसे गयसे हह, अतएव रदनकामंक 31.01.2016 क 03 रकाह ननोरटस पवीररयह रकानका जकायसेगका। जबरक यकाचवीगणनो दकारका इस शतर कनो रकाननसे कसे उपरकामंत हवी अपनसे आवसेदन पत्र ववीआरएस समंबमंधवी रदयसे हह , अततः बकाद रम इस रवषय पर रववकाद पहदका करनका आफ्टर थकाट हह। 21. That the contents of paragraph nos. 18 and 19 of the writ petition, as stated, are not admitted. In reply, it is respectfully submitted that the answering respondents have not violated the Circular dated 30.09.2015, where in paragraph no. 3 it is clearly mentioned that "रदनकामंक 31.01.2016 तक 03 रकाह ननोरटस पवीररयड रकानका जकायसेगका". In this regard, it is pertinent to state here that the petitioner no. 14, Shri Shailendra Kumar Srivastava, had sent several communications in this regard, and which have been replied by the Letter No.4363 dated 22.10.2016, inter-alia, informing him that "03 रकाह ककी ननोरटस पवीररयड कका भभुगतकान आप दकारका रकामंगका जकानका रवधध कसे प्ररतकट ल हह" 5. The Court takes note of above submissions as well as Government Order dated 30.09.2015 and its paragraph No.3, being relevant is referred hereinafter :- "3. ककारररककों ससे 31 अक्टटबर 2015 तक ववी०आर०एस०आवसेदन पत्र आरमंरत्रत रकए गए हह। अतएव 31 जनवरवी 2016 तक तवीन रकाह ननोरटस पवीररयड रकानका जकायसेगका। रकाह जनवरवी 2016 कसे पटवर ससेवका रनववृत्त हनोनसे वकालसे ककारररककों कसे ववी०आर०एस० सम्बन्धवी आवसेदन पत्र पर रवचकार नहहीं रकयका जकायसेगका। 4. धजन ककारररककों कनो ववी०आर०एस० कका आवसेदन पत्र अस्ववीककार रकयका जकायसेगका उन ककारररककों कनो इसकसे धलधखित ककारणकों कररचकारवी ससेवका रवरनयरकावलवी 2010 कसे रवरनयर समंख्यका 28 (ब) कसे अमंतगरत अवगत करकायसे जकानसे पर रवचकार रकयका जकायसेगका।" 6. Admittedly, the aforesaid Government Order is not under challenge, therefore, claim of petitioner being contrary to aforesaid part of circular cannot be allowed. 7. Learned counsel for petitioners submits that petitioners may be permitted to file amendment application to challenge the said Government Order, however, prayer is rejected since this petition is pending for last more than 7 years and petitioners have not filed any amendment application during aforesaid period. 8. In the aforesaid circumstances, claim of petitioners are contrary to provision and cannot be allowed. Accordingly, writ petition is dismissed. Order Date :- 28.7.2025 P.
