GP FOR REVENUE The Court made the following: 3 Order: Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action on the part of the respondents, particularly the 4th respondent, in attempting to dispossess the petitioner from his possession and enjoyment of the agricultural land to an extent of Ac.7.72 cents covered by Sy.Nos.217/2, 3, 4, 5, 6, 7, 8 (Old Sy.No.217/2) of Sampathipuram Village, Anakapalle Mandal, Visakhapatnam District, and to allot/assign house sites therein under the scheme Navaratnalu–Pedalandariki Illu, without issuing any notice, without conducting any enquiry and without passing any order as required under law. 3. On the other hand, the learned Assistant Government Pleader, relying upon the counter of the 4th respondent, submits that the subject land was initially proposed for house sites under the above said welfare scheme for housing for the poor. 4. In view of the interim orders of this Court, the same was not materialized. 5. In view of the above said facts and circumstances, the respondent Nos.2 to 4 are directed to deal with the subject land to an extent of Ac.7.72 cents in Sy.Nos.217/2, 3, 4, 5, 6, 7, 8 (Old Sy.No.217/2) of Sampathipuram Village, Anakapalle Mandal, Visakhapatnam District, strictly in accordance with law, if so warranted for any public purpose. If the petitioner is otherwise 4 found to be in possession of the same, he shall not be dispossessed from the subject land except by following the due process of law, giving due opportunity of hearing to all the parties concerned including the petitioner, upon verification of the records and the subject land, an appropriate decision shall be taken on its own merits. Any dispossession shall not be made except by following the due process of law. 6. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
