2 appearing for the State/respondents. 2. By filing the instant writ petition, the petitioner has prayed for following relief(s) :-
“a) It is prayed that this Hon'ble Court may kindly be pleased to call for the entire records concerning the tender process for Tender Notice No. 6363 dated 09/06/2025 for Request for Empanelment (RFE) (in Serial Nos. 84, 85, 86, 87, 88, 89, 90, and 91] for its kind perusal. b) That, this Hon'ble Court may kindly be pleased to issue a writ in the nature of CERTIORARI or any other appropriate writ/order/direction to quash and set aside the financial bid evaluation conducted by the Respondents for the aforesaid tenders and any subsequent actions, including the preparation of a final list of empaneled vendors or the issuance of any Letters of Award/work orders arising therefrom. c) That, this Hon'ble Court may kindly be pleased to issue a writ in the nature of MANDAMUS or any other appropriate writ/order/direction commanding the Respondents to: i. Forthwith disclose the complete technical evaluation scoresheets for all bidders who participated in the relevant tenders to ensure transparency. ii.
Re-conduct the financial bid opening for the said tenders, but only after providing a formal, written invitation to all bidders who have been found to be technically qualified as per the 60-mark threshold stipulated in Clause 20 of the RFE (Annexure P-1). 3 d) Issue any other appropriate Writ, order, or direction in furtherance of ensuring the rights of the Petitioner as this Hon'ble Court may deem fit in the peculiar facts and circumstances of the instant writ petition.”
3. Learned Advocate General submits that, as per the note-sheet dated 01.09.2025 of the Tender Committee, the petitioner’s bid was rejected on account of certain deficiencies, namely that the petitioner had submitted his bid in a single envelope, whereas the terms and conditions of the tender required that the bids be submitted in separate envelopes. It is further submitted that although such deficiency was noticed during scrutiny of the documents, the same was not communicated to the petitioner in writing. 4. In view of the above, the learned Advocate General is directed to communicate the reasons for rejection of the petitioner’s bid to the petitioner in writing. 5. At this stage, learned counsel for the petitioner seeks permission to withdraw the present writ petition, with liberty to file afresh if the petitioner is aggrieved by the rejection order, or to take recourse to such remedies as may be available to him under the law.
