The petitioner seeks pre-arrest bail in connection with Bettiah P.S. Case No. 446 of 2024 registered for the offence punishable under Sections 317(5), 318(4), 338, 336(3) and 340(2) of the BNS, 2023. 3. Considering the criminal antecedent of the petitioner, as well as, the material which has been collected in course of investigation against the petitioner, prima facie, case of theft of motorcycle is made out against the petitioner and using it in an illegal activity. I am not inclined to enlarge the petitioner on pre-arrest bail. 4. However, the petitioner, if so advised, may Patna High Court CR. MISC. No.37787 of 2025(4) dt.08-10-2025 2/2 surrender before the learned District Court and seek regular bail.
