Neutral Citation No. - 2025:AHC:79990-DB Court No. - 3 Case :- WRIT - C No. - 12854 of 2025 Petitioner :- Akhilendra Singh Respondent :- State Of U.P. And 6 Others Counsel for Petitioner :- Gajendra Singh Counsel for Respondent :- Shahabuddin,C.S.C.,Nayab Ahmad Khan Hon'ble Anjani Kumar Mishra,J. Hon'ble Jayant Banerji,J. Heard learned counsel for the petitioner and learned counsel for the respondents. From the instructions submitted today by learned counsel appearing for the respondents 4 and 5, it is reflected that two FIRs have been lodged, one against the respondent no.7, subsequently, another against the petitioner himself. This renders the claim of the petitioner disputed since the allegation made in the FIR relates to loss of the documents on the basis of which that claim of the petitioner is sought to be raised in this writ petition. Under the circumstances, since there would be disputed questions of fact, this Court in exercise of jurisdiction in writ petition, refuses to do so and by leaving it open for the petitioner to avail such remedy under the common law as may be advised. The writ petition is, therefore, dismissed. Order Date :- 15.5.2025 Mayank Digitally signed by :- MAYANK KUMAR SHARMA High Court of Judicature at Allahabad
