Page No.# 2/3 BEFORE HONOURABLE MR. JUSTICE BUDI HABUNG ORDER 12.09.2025 Heard Ms. G. Mamu, learned counsel for the petitioner. Also heard Ms. L. Hage, learned Additional Public Prosecutor for the State respondent. 2. Apprehending arrest in connection with Daporijo P.S. Case No. 60/2025, under Sections 316(5)/318(4) of the Bharatiya Nyaya Sanhita (BNS), 2023, the applicant filed the present application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, read with Article 21 of the Constitution of India, seeking pre-arrest bail. 3. By order dated 04.09.2025, this Court had granted interim pre-arrest bail to the accused/applicant with certain conditions. Upon obtaining the said order, the applicant appeared before the Investigating Officer (I.O.) on 08.09.2025, whereupon he was arrested and his statement was recorded. After completion of necessary formalities, the accused/applicant was released on interim pre- arrest bail upon furnishing a bail bond of Rs.1,00,000/- (Rupees one lakh only) with two sureties of like amount on the strength of the order dated 04.09.2025. 4. In this regard, Ms. Hage, learned Additional Public Prosecutor based on the record, submits that since the accused/applicant has appeared before the I.O. and has cooperated in the investigation, further custodial interrogation of the accused/applicant is not required in the interest of the investigation. 5. Considering the submissions made by the learned counsel for both sides, and the fact that the applicant has been cooperating with the I.O. and his statement has already been recorded, I find it appropriate to allow the prayer

Accordingly, the interim pre-arrest bail granted to the accused/applicant vide order dated 04.09.2025 is hereby made absolute on the same terms and conditions, excluding Condition No. (i), i.e., 'that the accused/applicant shall appear before the I.O. of the case within five (5) days from today to record his statement’. 7. This bail order shall be read along with the order dated 04.09.2025. 8. In terms of above, this anticipatory bail application stands disposed of. JUDGE Comparing Assistant
