Order on Board
21.01.
2025
1. This is an ofÏce reference.
2. This Court, vide order dated 03.07.2024, passed in MCRC No. 3579 of 2024, while rejecting the bail to the applicant, namely, Kripal Dewar, had expressed its trust that the trial Court should make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of six months from the date of receipt of a certified copy of this order, if there was no legal impediment.
3. The learned Special Judge (NDPS Act), Kabirdham, District- KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 Kabirdham, (C.G.) vide his request letter dated 02.01.2025 has requested for grant of some more time for concluding the trial.
4. It transpires from perusal of the PUD, that the prosecution has presented a list of 15 witnesses as per the trial program, out of which the testimony of 12 witnesses has been completed. However, the testimony of two crucial witnesses, including the investigating ofÏcer and one other witness, could not be recorded despite repeatedly issuing arrest warrants. Since their presence could not be ensured. In this situation, it seems unlikely that the case can be concluded within the stipulated timeframe. Hence, she prays for grant of further more time for concluding the trial.
5. The request appears to be reasonable. The concerned trial Court is
directed to conclude the trial as early as possible, preferably within a further period of four months from today.
6. Accordingly, this CRMP stands disposed off with the aforesaid direction.
7. Registry is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
