1. The applicant has preferred this application under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No.306/2025, registered at Police Station – Surajpur District – Surajpur (C.G.) for the alleged commission of offence punishable under Sections 20(C), 29 of NDPS Act.
2. As per prosecution story in brief is that 31 bottles of Onrex cough syrup were allegedly recovered from co-accused Moh. Shahid Raza on
23.06.2025. The applicant’s name does not appear in the FIR, no VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.12.16 11:01:58 +0530
2 recovery has been made from him and no incriminating material has been seized at his instance.
3. None appeared nor any representation made on behalf of the applicant on repeated call.

On the other hand, learned State counsel opposes the bail application of the applicant and submits that applicant has no criminal antecedent and contraband article i.e., 31 bottles of Onrex cough syrup were recovered from co-accused Moh. Shahid Raza on 23.06.2025 and on the basis of his memorandum statement, present applicant is implicated in the present case, therefore, applicant is not entitled for grant of anticipatory bail.
5. I have heard learned counsel for the State and perused the case diary.
6. Recently the Supreme Court in the matter of Anarul SK v. The State of West Bengal {SLP (Crl.) No(s). 12621/2024 has observed that the grant of anticipatory bail in cases involving Narcotic Drugs and Psychotropic Substances (NDPS) is a very serious issue.
7. In the light of observation made by the Supreme Court in Anarul SK (supra), I do not find any good ground to entertain this anticipatory bail application. Accordingly, the present anticipatory bail application is dismissed. Sd/- (Ramesh Sinha) Chief Justice vaishali
