Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home. 03. Learned counsel for the petitioner submitted that police are calling the petitioner to the police station and threatening to implicate her in false criminal cases, if petitioner does not yield to the terms of the respondents 5 to 8 concerning matrimonial related issues. Learned counsel would further submit that no crime has been registered against the petitioner in the police station. 04. Learned Assistant Government Pleader for Home seeks time to get instructions. 05. Instead of adjourning the matter, this court is inclined to dispose of the matter at the admission stage. 06. In the present case, it is not disputed that no crime has been registered against the petitioner. Therefore, the action of the respondent police in 4 summoning the petitioner to the police station or compelling him to settle disputes is clearly unsustainable. In the absence of any such registration of crime, respondent Nos.4 is directed not to call the petitioner to the police station or interfere with his liberty in any manner, except in accordance with law. However, in the event, any crime is registered against the petitioner in future, it shall be open to the police to secure his presence before the investigating officer strictly in accordance with due process of law. Accordingly, the writ petition is disposed of. There shall be no order as to costs.
