Present applicant is seeking regular bail in relation to FIR dated 03.03.2025 bearing FIR No. 0271 of 2025 Police Station – Laksar, District – Haridwar wherein present applicant has been implicated for the offences punishable under Sections 8 / 21 NDPS Act. 4. Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated and the contraband (Smack), which is shown to be recovered from the applicant is 18.79 gram, is below commercial quantity. He further submits that there is no proper compliance of Section 50, 52, 55 and 57 of the NDPS Act and applicant has no previous criminal history. 5. On the other side, learned AGA for the State fairly submits that applicant has no previous criminal history and the contraband, which is shown to be recovered from the applicant, is below commercial. However, he denied that there is no compliance of provisions of the NDPS Act. He further submits that investigation is still going on. 6. After hearing learned counsel for the parties and further taking into consideration that applicant has no previous criminal history and the contraband, which is shown to be recovered from the applicant is below commercial quantity, this Court is of the view that applicant deserves for bail but by putting some stringent condition. Accordingly, without expressing any opinion on the merit of the case, bail application is allowed. 7. Let the applicant – Mohseen be released on bail on furnishing a personal bond and two sureties, each of the like amount to the satisfaction 2025:UHC:2510 of court concerned. 8. It is made clear that after being released on bail, applicant ensure his presence at the nearest police station in every fifteen day. The SHO of the police station concerned shall mark his presence.
