Krishna Mohan) Heard the learned Standing Counsel for the appellants and the learned counsel appearing for the respondent. This writ appeal is filed against the interim order passed by the learned Single Judge of this Court in I.A.No.1 of 2024 in W.P.No.29594 of 2024 dated 08.01.2025 suspending the impugned proceedings of the 2"^^^ respondent therein dated 04.10.2024, in so far as the writ petitioner/1®' respondent herein 2. is concerned. The learned Standing Counsel for the appellants submits that the respondent herein is effected under the impugned appellant herein dated 04.10.2024, in view of the 3. St transfer of the 1 nd proceedings of the 2 administrative exigency and at the request of the 4'*^ appellant herein, vide letter dated 26.09.2024 addressed to the 3'"' appellant, wherein, he sought for transfers and postings in respect of 6 Deputy Executive Engineers and 2 Assistant Executive Engineers for smooth running of the project. He further requested to arrange postings of 20 Deputy Executive Engineers and 6 Assistant Executive Engineers also. Accordingly, the impugned proceedings vide memo dated 04.10.2024 appellant herein, in which, the 1®' respondent herein was figured at Serial No.29. According to which, the 1®* respondent herein is 4. was issued by the 2nd 3 HBKM,J&HVN,J W.A.No.68of2025 working at Vidyut Soudha, who is posted on transfer at SDSTPS (on deputation). 5. On the other hand, the learned counsel appearing for the respondent herein submits that the Hon’ble Single Judge mainly relied upon the General Transfer Policy and Guidelines governing the Corporation vide G.O.O.No.133/JS(Per.)/2024 dated 25.08.2024. According to which, the 1®‘ respondent herein in the ordinary course of employment shall not be affected with the transfer at this juncture. 6. He also submits that, the impugned proceedings of the 2'"'^ appellant herein does not contend the reasons mentioned in the letter of the 4^^ appellant addressed to the 3'"^ appellant dated 26.09.2024. 7. In view of the above said facts and circumstances, as this writ appeal arises only against the interim order passed by the learned Single Judge and as the main writ petition is pending, wherein, the pleadings are complete, we do not incline to interfere at this stage with the interim order passed by the learned Single Judge of this Court. However, we direct both the parties to appear before the learned Single Judge for early disposal of the writ petition. When such request is made, the learned Single Judge can consider the same for early disposal of the writ petition, since it is only a transfer of one of the employees and as the department is also contending that due to the administrative exigency and requirement, the respondent is sought to be transferred under the said impugned proceedings. 4 HBKM,J&HVN,J W.A.No.68 of 2025 8. Accordingly, this Writ Appeal is disposed of. There shall be no order as to costs. As a sequel, Interlocutory Applications pending if any, shall stand closed.
